1. Identification of the Parties

These General Conditions of Use are entered into on one part by the Owner and on the other by you, as a User (natural or legal person) who voluntarily accesses the Website freely and free of charge. These conditions shall apply regardless of whether or not the services offered on the platform are contracted.

2. Object of the Website

This platform is a live streaming service through which:

  • Streamers may broadcast audiovisual content.

  • Registered Users may access said content during its broadcast. Access and navigation through the Website are free, although access to certain content or services may entail the payment of a price, as well as the acceptance of specific Particular Conditions.

3. User Obligations

By merely accessing and browsing the Website, the User must:

  • a. Use the Website in a diligent, correct, and lawful manner, respecting current legislation, morality, and public order.

  • b. Periodically review these Conditions for potential modifications.

  • c. Review communications sent by Admefy, as they may contain important information.

  • d. Not use the Website to collect information to provide services that constitute direct competition for Admefy.

  • e. Not modify or simulate the appearance or functions of the Website.

  • f. Not damage, disable, or overburden the service or connected networks.

  • g. Refrain from introducing viruses, worms, Trojans, or any malicious code.

  • h. Not employ reverse engineering to discover Admefy’s source code.

  • i. Not violate intellectual or industrial property rights (patents, trademarks, copyrights) of the Owner or third parties.

4. Availability of the Website

The Website is provided “as is” and “as available”, subject to limitations and concurrent circumstances, although the Owner continuously strives to improve and expand its services.

5. Particular Registration Conditions

5.1. Requirements and Procedure to Create an Account

Users must be of legal age under Spanish law. The registration process differs between Streamers and Registered Users.

  • a. Streamer Registration Process: Must provide full name, email, and password. By accepting, the Streamer consents to the use of the image they publish on the platform. Legal entities must be represented by an authorized person.

  • b. Registered User Process: Must follow the “Sign Up” steps, providing name, email, and password. Acceptance implies consent for the platform to use images published by the user.

5.2. Services Offered

  • Registered Users: Access to a personal area and content (free or paid).

  • Streamers: Live content broadcasting, provided technical and legal requirements are met.

5.3. Obligations of the Registered User

  • Provide real data and not impersonate third parties.

  • Maintain the confidentiality of access data; the user is responsible for all activities performed from their account.

  • Do not sell or transfer the account to third parties.

6. Particular Conditions for Service Subscription

6.1. Admefy as a Technological Intermediary Admefy acts as an intermediary platform. It does not control or supervise content; it only provides the tool for Streamers to broadcast to Users.

6.2. Contracting Parties

  • The Owner (Ad Screen World, S.L.): Technological intermediary. The contract for content is always between the Streamer and the User.

  • The Streamer: Identified at the time of subscription.

  • The Registered User: Who voluntarily subscribes to services.

6.3. Subscription Process

  • Users must select a monthly or annual plan.

  • Registration and identification of payment methods (currently credit card) are required.

  • Acceptance allows Admefy to send electronic invoices.

6.4. Terms between Streamers and Users

  • Generalities: Specific terms (duration, dates, prices, cancellation) are set by the Streamers. The Owner is not responsible for incidents arising from these private contracts.

  • Pricing Policy: Prices are shown in Euros and broken down by applicable taxes.

  • Withdrawal/Cancellation: Generally, there is no right of withdrawal once digital content has been accessed, unless otherwise agreed.

7. Exclusion of Liability

  • 7.1. Services are shown according to current availability.

  • 7.2. The Owner does not guarantee the absence of viruses or external intrusions, despite security efforts.

  • 7.3. No responsibility is assumed for third-party links.

  • 7.5. The Owner is not a concert organizer and does not moderate content, though it monitors legality.

  • 7.6. Under Law 34/2002, the Owner is not liable for content hosted by Users unless they have actual knowledge of illegality and fail to act diligently to remove it.

8. Intellectual and Industrial Property

All rights to the platform, brand, and design belong exclusively to the Owner. Unauthorized reproduction or transformation is strictly prohibited. Streamers assume full responsibility for the content they broadcast and must hold the necessary rights.

Content Broadcast Conditions

1. Identification of the Parties

Regulates the direct live streaming services between Ad Screen World, S.L. (Intermediary) and the Streamer (The person/entity broadcasting).

2. Object

Establishing the framework for content transmission. The Owner provides the platform to allow Registered Users to access the Streamer’s live feed.

3. Transmission and Rules

  • 3.1. Process: Streamers must provide business/tax data (NIF/CIF) if acting for commercial purposes and link a Stripe account for payments.

  • 3.2. Rights: The Streamer must own the content or have authorization. They must provide data for intellectual property rights management (SGAE, etc.).

  • 3.3. Fees: Admify charges a commission for each subscription for platform management and server maintenance.

4. Streamer Obligations

  • Broadcast the announced content at the scheduled times.

  • Guarantee the truthfulness of provided data.

  • Hold the Owner harmless from any third-party claims.

11. Other Matters

  • 11.2. Language: The applicable language is Spanish. Any English version is provided as a courtesy; in case of contradiction, the Spanish version prevails.

  • 11.3. Jurisdiction: Relationships are governed by Spanish law. For non-consumers, any conflicts will be resolved in the Courts of Ibiza.
